Mitch Evans (Atlanta, GA) (Bad Faith) obtained a Motion for Summary Judgment for Safeway Insurance. Safeway’s insured was sued on negligent entrustment / family purpose theories for death claim. Safeway denied coverage as the vehicle driven by the at-fault party had been deleted from the policy by the insured the day prior to the accident. No defense was provided and the insured had a $1,000,000.00 default judgment entered against her. Plaintiff’s counsel sent the insured to Shiver & Hamilton who filed a bad faith suit on the insured’s behalf. Judge Gordon granted Safeway’s Motion for Summary Judgment. The Plaintiff appealed the grant of the MSJ and we are currently waiting on the decision from the Court of Appeals.
